Terms of Service

In brief

You keep ownership of your work. You give galeria.casa only the permission needed to operate the service according to your settings. The beta is free, invite-only, available only to adults in the United States and Mexico, and is not an archival service. Follow the Content Guidelines and do not upload work or information you lack permission to use.

These Terms are an agreement between you and Albertson Product Development LLC, a Washington limited liability company (“galeria.casa,” “we,” “us,” or “our”). They govern your access to galeria.casa and its related services (the “Service”). By creating an account or accepting these Terms, you agree to them, the Privacy Notice and the Content Guidelines.

1. Eligibility and accounts

You must be at least 18 years old and a resident of the United States or Mexico to hold a beta account. You must provide accurate information, keep your sign-in credentials secure, and promptly tell us at [email protected] if you believe your account has been compromised. Waitlist availability in another country does not promise account access there.

Invitations are personal unless we say otherwise. You are responsible for activity under your account and for collaborators you authorize. Do not sell, transfer, or share account access in a way that defeats our controls.

2. The beta

The Service is a free, invite-only beta. There are no subscription, renewal, cancellation, or refund terms because we do not currently charge for the Service. Any paid offering will require separate product and policy changes before charges begin.

The beta may change, experience interruptions, lose features, or end. It is not an archival guarantee. Keep independent copies of work and records you cannot afford to lose. Export tools and backups may reduce risk, but they do not replace your own archive.

3. Your content and ownership

“Your Content” means images, writing, catalog information, gallery materials, messages, and other material you or your authorized collaborators submit to the Service.

You retain ownership of Your Content. You grant us a non-exclusive, worldwide, royalty-free license to host, copy, compress, resize, create technical delivery formats, back up, transmit, and display Your Content only as needed to:

  • operate, secure, maintain, and improve the Service;

  • present Your Content according to your visibility and sharing settings;

  • make requested exports and backups; and

  • comply with law and enforce these Terms.

This license lasts while Your Content remains in the Service and for the limited time needed to complete deletion from active systems and ordinary backup rotation, subject to narrow legal, security, accounting, or dispute-preservation needs. It does not give us permission to train generative-AI models on Your Content or use it in external advertising, promotion, or marketing without separate permission from you.

You represent that you have the copyright, trademark, privacy, publicity, depicted-person, and other permissions needed to submit and use Your Content as configured. You remain responsible for Your Content and for deciding whether making it public is appropriate.

4. Visibility and public material

“Public” content may be indexed by search engines and viewed, linked, cached, downloaded, or copied by others. Changing a setting or deleting content may not remove copies already held by other people, search engines, browser caches, or lawful archives.

“Unlisted” means omitted from ordinary galeria.casa listings. It does not mean private or access-controlled: anyone who obtains or guesses the URL may be able to view it. Password or opaque-link sharing is suitable only for casual access control, not highly confidential material.

5. Acceptable use

You must follow the Content Guidelines. In particular, do not use the Service to infringe rights; exploit or endanger people; facilitate unlawful conduct; impersonate or defraud; distribute malware or spam; evade enforcement; or upload substantially generative-AI-created work prohibited by the Guidelines.

Do not interfere with the Service, probe it without authorization, scrape it in a way that harms availability, bypass access limits, or use it to build a competing dataset or machine-learning model from other users’ content.

6. Moderation and enforcement

We may investigate reports and remove, restrict, preserve, or disable access to content. We may suspend or terminate accounts when reasonably necessary for policy enforcement, safety, legal compliance, service protection, repeated infringement, or material breach of these Terms. Moderation is reactive and risk-based; we do not promise to pre-screen every upload or resolve every private dispute.

Where practicable, we will consider context and give notice. Urgent risk, legal restrictions, security needs, or repeated abuse may require action without advance notice. You may appeal by emailing [email protected]; include the affected account or URL and why you believe the decision should change. We do not promise a formal tribunal or response deadline.

Do not upload copyrighted material unless you have permission to use it. We may remove or restrict material that appears to infringe copyright or other rights. Report copyright, trademark, privacy, publicity, impersonation, or other rights concerns to [email protected] with enough detail for us to evaluate them.

8. Third-party services

The Service depends on providers for hosting, storage, content delivery, email, image processing, monitoring, analytics, certificates, and related operations. Their systems may fail or be unavailable. We are responsible for our selection and use of service providers as described in the Privacy Notice, but we do not control independent third-party sites, recipient email systems, or services you choose to link.

9. Export, closure, and termination

You may stop using the Service at any time. When account export and closure controls are available, they will provide the highest-quality version then stored, which may not be an untouched original upload. Deletion from active systems and ordinary backups follows the limits described in the Privacy Notice.

If we discontinue the Service or terminate an account for reasons other than urgent risk, illegality, or serious breach, we will provide reasonable notice and an opportunity to export where practicable. We may close inactive accounts after reasonable advance notice where practicable.

Sections that by nature should survive—such as ownership, limited retained-license needs, disclaimers, liability limits, indemnity, and disputes—survive termination.

10. Disclaimers

To the fullest extent permitted by law, the Service is provided “as is” and “as available.” We do not warrant uninterrupted or error-free operation, permanent storage, preservation of image quality or metadata, a particular audience or result, or that every harmful or infringing item will be found. We do not exclude warranties or rights that cannot lawfully be excluded.

11. Limits of liability

To the fullest extent permitted by law, neither party is liable to the other for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, goodwill, or data, arising from the Service—even if advised that such harm was possible.

Our total liability arising from the Service will not exceed the greater of US$100 or the amount you paid us for the Service during the 12 months before the event giving rise to the claim.

These limits do not apply where prohibited by law or to liability that cannot lawfully be limited, including liability for fraud, willful misconduct, or death or personal injury caused by negligence where applicable. Non-waivable consumer rights remain intact.

12. Your responsibility to indemnify us

To the extent permitted by law, you will defend and indemnify Albertson Product Development LLC and its personnel against third-party claims, damages, and reasonable costs arising from (a) Your Content infringing another person’s rights, (b) your unlawful conduct through the Service, or © your material breach of these Terms. This does not apply to claims caused by our own conduct, and we will give reasonable notice and allow you to participate in the defense. You may not settle a claim in a way that admits our fault or imposes obligations on us without our consent.

13. Changes

We may update these Terms as the Service or law changes. For material changes, we will give reasonable advance notice. When a change materially affects the agreement, we will ask for fresh affirmative acceptance before continued account use. The published version and effective date show which Terms apply.

14. Disputes and governing law

Before filing an ordinary lawsuit, you and we agree to try in good faith to resolve the dispute informally for 30 days after written notice. Send notice to the contact below; we will use your account contact unless you provide another address.

Washington law governs these Terms, without regard to conflict-of-law rules, while preserving rights you cannot waive under applicable local law. Ordinary proceedings must be brought in state or federal courts serving King County, Washington, subject to non-waivable law. Either party may bring an eligible claim in small-claims court. These Terms do not require arbitration and do not include a class-action waiver.

15. General terms

If one provision is unenforceable, the rest remains effective and the provision will be limited only as necessary. A delay in enforcement is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a merger, acquisition, reorganization, or transfer of the Service, subject to applicable law and notice obligations. These Terms and the incorporated policies are the entire agreement about the Service.
